TERMS AND CONDITIONS

By availing and using the PLDT Home WiFi 5G+ service (the “Service”) provided by Smart Communications, Inc. (“SMART,” “We,” or “Us”), the Subscriber (“You,” or “Yours”) agrees to the following Terms and Conditions pertaining to the use of the Service as well as the Terms and Conditions for SIM Registration (the “SIM Registration Terms and Conditions”) found in https://smart.com.ph/Corporate/terms/simreg. In case SMART makes changes to these Terms and Conditions that would materially change your rights and obligations in the use of the Service, we shall notify you of such changes. Your continued use of the Service following the posting of these changes to these Terms and Conditions will be construed as your acceptance of the amended Terms and Conditions. These Terms and Conditions shall be in effect from the date of availment of the Service.

  1. The Service.
    1. PLDT Home WiFi 5G+ (the “Service”) provides the Subscriber a fixed wireless access to the internet by connecting to an indoor Customer Premises Equipment (“CPE” or the “Device”) at home that is bundled with a 5G PLDT Home WiFi SIM inserted in the Device and a free unlimited WiFi for 15 days from activation of the SIM (the “Prepaid Subscription”).
    2. The Service is prepaid which enables the Subscriber to load the account based on chosen time and amount. There is no monthly bill and lock-in period.
    3. The Service is available to subsribers in identified 5G and 4G areas covered by the nationwide SMART network.
    4. To enjoy the best 5G service, the Subscriber must be in an area covered by SMART’s 5G network and must be using the SIM and the Device bundled with the subscription.
    5. The Subscriber acknowledges and accepts that he or she accesses and uses the Service at his or her own risk. SMART shall not be responsible for and does not guarantee the functionality, availability, or continuity of the Service at any time. SMART shall not be liable or responsible for any damage or loss suffered or incurred by the Subscriber that may arise by reason of or in connection with the provision of the Service or the access or use of the Service by the Subscriber.
    6. The Device and SIM are neither refundable nor redeemable for cash, either in part or in full.
    7. SMART reserves the right to SIM-lock devices as part of the PLDT Home WiFi 5G+ kit for use only of its own services. A PLDT Home WiFi 5G+ kit, availed from SMART, is qualified to be unlocked only after 24 months.
    8. from date of purchase by providing a valid Official Receipt and the device’s IMEI number.
  2. SIM Registration.
    1. To activate the PLDT Home WiFi 5G+ Service, the Subscriber must first register the 5G SIM that is inserted to the modem. The subscriber must get the PLDT Home WiFi number / MIN from the sticker located at the back or bottom of the modem and register the SIM in their name in accordance with the SIM Registration Act.
    2. To complete the SIM registration, the Subscriber must get the One-Time Passcode (OTP) from the device dashboard by visiting https://192/168.1.1 while conected to PLDT Home WiFi and may view instructions from pldthome.com/homewifi/viewbroadbandsms
  3. Usage.
    1. The Subscriber may top-up from any of the following channels: Smart App, e-wallet providers such as Maya, e-commerce platforms, digital platforms of banks, PLDT and SMART stores, self-load machines, convenience stores, sari-sari stores and SMART retailers, telco tiangge, remittance centers, pawnshops, malls, transport kiosks, supermarkets and groceries.
    2. The Subsriber may download and use the Smart App to view account details, load balance, earn points and rewards and avail of the latest promos.
    3. The Subscriber may choose from any SMART loads for the Service. SMART has the sole right to change the loads and offers at any time without prior notice.
    4. The SIM can only be used for the device it is bundled with. The Susbcriber shall not remove the SIM to avoid issues with the Device and SIM warranty, connection, and/or promo subscriptions.
    5. The SIM provides data service only and has no capability to make, receive and send calls or text messages.
  4. Disconnection.
    1. The Service requires for its use, reload of value through the Smart App or SMART Load. After value is loaded, such value shall be valid for a specific period of time as indicated at the time of purchase or loading, as the case may be. It shall be the Subscriber’s responsibility to be informed of the validity and the specific terms and conditions of any load package loaded or purchased.
    2. The PLDT Home WiFi SIM will be PERMANENTLY DISCONNECTED: (1) if the Subscriber fails to comply with the SIM Registration Terms; (2) if the SIM remains unactivated or unused until the indicated expiry date on the SIM Card packaging, or (3) if the activated SIM card has zero load balance for at least one hundred eighty (180) consecutive day
    3. Disconnected Prepaid SIMs will not be reconnected, and mobile numbers associated with the disconnected Prepaid SIMs cannot be reacquired. A new SIM must be purchased to continue availing the Service. SMART shall not be held responsible to replace any permanently disconnected SIMs. To avoid getting disconnected and to continue using the Service, the Subscriber must top up his account with any regular load amount.
  5. Device Warranty.
    1. The Device, SIM and initial load are non-refundable and non-replaceable in case of loss, theft, or damage due to misuse, mishandling or negligence, or willful misconduct.
    2. The Device has a manufacturer’s service warranty for one (1) year from date of purchase. Removal of the SIM from the Device and/or broken/tampered SIM sticker will result in the cancellation of this 1-year warranty.
    3. In case of repair and replacement, the Subscriber must present the proof of purchase to avail of the warranty.
    4. If the Device and/or SIM are found to have inherent defects, the Subscriber may request replacement within seven (7) days from date of purchase at the nearest PLDT Home or SMART store. Otherwise, the Subscriber may call 02-87224307 or bring the Device to authorized Service Centers nationwide within the 1-year warranty period.
    5. In case of void or beyond the 1-year warranty period, the Subscriber shall shoulder the cost of the repair of the Device.

  7. Force Majeure.
    SMART shall not be responsible for damages, delays, non-performance or failure in performance resulting from acts or occurrences beyond its reasonable control, including, without limitation: fire, lightning, explosion, power surge or failure, flood, typhoon, acts of God, war, revolution, civil commotion or acts of civil or military authorities or public enemies; any law, order, regulation, ordinance or requirement of any government or legal body or any representative of any such government or legal body; or labor unrest, including, without limitation, strikes, slowdowns, picketing or boycotts; inability to secure raw materials, transportation facilities, fuel or energy shortages, or acts or omissions of other common carriers.
  8. Disclaimers.
    YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. THE INFORMATION, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SERVICE ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT OF INTELLECTUAL PROPERTY, EXCEPT AS OTHERWISE PROVIDED IN THESE TERMS AND CONDITIONS. WHILE WE TRY OUR BEST TO PROVIDE THE MOST ACCURATE AND UP TO DATE INFORMATION, SMART DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE INFORMATION, MATERIALS OR SERVICES PROVIDED ON OR THROUGH THE SERVICE. SOME INFORMATION, MATERIALS, AND SERVICES PROVIDED MAY BE OUT OF DATE AND SMART DOES NOT MAKE ANY COMMITMENT OR ASSUME ANY DUTY TO UPDATE SUCH INFORMATION, MATERIALS, OR SERVICES. THE FOREGOING EXCLUSIONS OF IMPLIED WARRANTIES DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW.
  9. Limitations of Liability.
    SMART does not assume any responsibility for, and will not be liable for, any damages to, or any viruses that may infect your devices, telecommunication equipment or other property caused by, or arising from the Service. We do not guarantee continuous, uninterrupted, or secure access to the internet through the Service as the Service may be interfered with by numerous factors outside of our control. IN NO EVENT WILL SMART OR ANY OF ITS OFFICERS, DIRECTORS, BOARD OF TRUSTEES, EMPLOYEES, SPONSORS, SHAREHOLDERS, AGENTS, SUCCESSORS OR ASSIGNS, NOR ANY PARTY INVOLVED IN THE CREATION, PRODUCTION OR TRANSMISSION OF THE SERVICE, BE LIABLE TO YOU OR ANYONE ELSE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING FROM THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LAW AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS OF LIABILITY DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW. IN THE EVENT OF ANY PROBLEM WITH THE SERVICE, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE SERVICE.
  10. Indemnity.
    You agree to defend, indemnify and hold SMART free and harmless from any and all liabilities, costs, and expenses, including reasonable attorneys’ fees, related to or in connection with:
    (a) the use of the Service or the Internet; (b) your violation of any of these Terms and Conditions, including without limitation, your breach of any of the representations and warranties above; (c) your violation of any third-party right, including without limitation any right of privacy, publicity rights or intellectual property rights; and (d) your violation of any law, rule or regulation of the Republic of the Philippines relating to your use of the Service.
  11. Release.
    In the event that you have a dispute with one or more other users of the Service, you release SMART (and each of our officers, directors, board of trustees, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
  12. Applicable Laws and Venue.
    These Terms and Conditions shall be construed and enforced under the laws of the Republic of the Philippines. The parties hereby consent to and submit to the exclusive jurisdiction of the courts in Makati City, Philippines.
  13. General.
    If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be deleted and the remaining provisions shall continue to be enforced. You agree that these Terms and Conditions and all incorporated agreements may be automatically assigned by SMART at our sole discretion. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or other subscribers does not waive our right to act with respect to subsequent or similar breaches. These Terms and Conditions set forth the entire understanding and agreement between us with respect to the subject matter hereof. Sections 10 (Limitations of Liability), 11 (Indemnity), and 12 (Release) shall survive any termination or expiration of these Terms and Conditions or your use of Service.
  14. Entire Agreement.
    These Terms and Conditions are the entire agreement between the Subscriber and SMART and supersede any prior understandings or agreements (written or oral). If you do not agree to these Terms and Conditions, please do not continue using the Service.
    SMART reserves the right at its absolute discretion to modify, delete or add to any of these Terms and Conditions at any time without further notice. It is the Subscriber’s responsibility to regularly check any changes to these Terms and Conditions available in the website. The Subscriber’s continued use of the Service after any such changes constitutes acceptance of the new Terms and Conditions.
  15. Intellectual Property Notice. SMART is the owner of the Service and the owner/ authorized licensee of all copyright, trademarks, design rights, content, graphics, text selections, or any other intellectual property rights used in the Service. All rights are reserved.
